Religious Observance and Instructional Time Policy Statement


Purpose

University Preparatory Academy (UPA) is committed to maintaining an inclusive school environment that respects the religious beliefs, practices, and expressions of students and families while preserving the instructional time necessary to fulfill the school’s academic mission.

This policy establishes UPA’s expectations regarding requests for students to be released from regularly scheduled instructional time for religious observance, prayer, or related activities.

Policy Statement

UPA does not provide recurring exemptions or releases from regularly scheduled instructional time for religious observance, prayer, or religious instruction.

Requests for students to miss instructional time will be evaluated based on educational and instructional impact and applicable attendance requirements, without consideration of whether the underlying reason is religious or non-religious. This standard will be applied consistently and neutrally to all students and families.

UPA’s legal review concluded that California Education Code section 46014 permits, but does not require, schools to release students for religious instruction or exercises and that charter schools are exempt from the requirements of that provision under Education Code section 47610. The legal guidance further supports the school applying a neutral standard when considering such requests.

Religious Expression During Non-Instructional Time

Nothing in this policy is intended to prohibit or discourage lawful student religious expression.

Students may engage in voluntary, private prayer or religious expression during appropriate non-instructional times, such as lunch or recess, provided that the activity does not disrupt school operations, interfere with the rights of others, or otherwise conflict with applicable school rules.

When appropriate and reasonably available, UPA may provide a space for private prayer during non-instructional time.

Instructional Time

Regular and consistent participation in instruction is central to UPA’s academic program. Recurring absences from instructional periods may result in students missing direct instruction, classroom activities, assessments, collaborative learning, and other academic experiences that cannot always be replicated outside the classroom.

Accordingly, UPA will not establish a religious exemption from instructional time. This approach is intended to protect instructional integrity and ensure that requests for release from instruction are handled consistently.

Neutral and Consistent Application

UPA will administer this policy without favoring or disfavoring any religion, religious practice, or non-religious belief.

School personnel reviewing requests for release from instruction will base their decisions on legitimate educational considerations, including instructional impact, rather than the religious or non-religious nature of the activity for which the student seeks release.

Family Communication

UPA recognizes that religious observances and practices are important to many families. Families are encouraged to communicate with school administration regarding circumstances that may affect their student’s attendance or participation in the school program.
